301 old site to new site?

I have client with an old site - www.bestfamilylawattorney.com - which had a lot of spammy links (and bad rankings). Instead of fixing those issues, we started a new URL - www.berenjifamilylaw.com - with new content and redesign.
Should I do a 301 redirect from old to new domain? If the old site was being penalized, would a 301 transfer that penalty?
I just want to make sure I don't end up hurting the new site after doing all the work to start fresh.

With my experience I would say, if the site is not penalised , then there is nothing stopping you to do 301 redirect.

I'd be pretty hesitant to redirect that site without disavowing each and every spammy link beforehand. Added to that, if it's currently a very low traffic site, and you can quickly reach those levels by emailing current clients directly announcing the new site, I'd just abandon it all together. Better to start fresh on the right foot than to carry the old baggage along with it.

I agree with you but I would not disavow anything. I will just abandon it and start all over. I am reading on http://www.webmasterworld.com/google/4576936.htm that is not working the tool. If you do an extensive research you will find more sources reporting that its not working. So I wouldn't risk anything.
