Have a look at how Moz now calculates the spam score, it is done based on correlation with characteristics of other band websites. That is to say just because it's a high spam score doesn't mean to say it's going to do you damage. However I always steer completely clear of any indication of spam. I would consider 20% plenty high enough, at 40% I would completely avoid it and put my effort elsewhere.
