Yes, you need to focus on yourself. In due time he will be removed, it just takes patience. You can also report his website for breaking the ToS for Google, if he is doing black hat stuff. Duplicate content is not black hat, so you'd need to prove that he is doing cloaking or something similar to that.

Focus on links, a broad variety of links, and high quality content. You'll eventually get there!

But duplicate content is a factor to get removed or not? This is the site that i was talking about : http://www.transportadorabr.com.br/transportadora/transportadora.asp Look the links in left side after "Links úteis". When you click you are gonna the same content in all the pages. Still not black hat?

Duplicate content is not an issue for which you will be penalised.

If all the pages are the same then chances are that only one page will rank for the content, but it's not black hat to have several pages with the same content (just usually a poor choice). However it doesn't seem as if every page is the same.

I don't see anything against Google's guidelines going on on that site (I've not looked hard) so your best bet is to just keep building more links adding better content.

Unfortunately, as Barry said, there is no rules being broken here. What they're breaking is a best practices kind of thing, but that wont get them in trouble with Google.

Focus on having quality writers create you top notch content, go after some high authority links like .EDU, and just keep trying hard. You'll get there!

Had a similar situation for a competitor site; best idea is to not get jealous over their high ranking - if they are doing something against Google rules then they will get a penalty in due time - don't resort to doing the same thing for a short term benefit, it won't work out in the long term. You can always report them if you think something is wrong.

Keep at it, focus on your own work and concentrate on improving where your site where you can, but don't get distracted by any black hat tactics used by competitors or you'll just join them when the penalty hits.
