For sure! Once the customer is at checkout or the receipt page, hit them up there. That's where I do it. ALSO, I have the Newsletter subscription in the footer.

One word - GIVEAWAYS.

I am running a special right now and one of the rules of entry are:

Newsletter sign up upon other data driven needs.

The giveaway has to be GREAT and trust me - works like a charm.

I am running a giveaway for 2 tickets to a NBA Playoff game.

Pro - We are already up to 900+ subscribers for the start of May.

Con - Not EVERYONE is interested in the products and or offer.
